Taiwan plans to turn unauthorized exports of AI chips to China into a criminal offense, removing a legal safe harbor that smugglers have exploited for years, Tech Times reports.
The move targets a persistent gray channel. Chips restricted under export controls have reached Chinese buyers through intermediaries, shell companies and transit hubs. Under current Taiwanese rules, violators face administrative penalties in most cases. Criminal liability would change the calculus for brokers, traders and logistics firms.
What does the proposed law change?
The legislation would criminalize the export of AI chips to China without government authorization. Taiwan already requires export licenses for sensitive technology shipments to the mainland. The gap has been enforcement. Administrative fines and license revocation have done little to deter organized smuggling networks.
Criminal prosecution raises the stakes. Individuals involved in illegal transfers would face potential prison terms rather than fines alone. That applies to exporters, brokers and anyone in the supply chain who knowingly moves restricted silicon to prohibited destinations.
Taiwan's chip industry sits at the center of the global AI supply chain. TSMC produces the bulk of the world's most advanced processors, including the AI accelerators that power data centers in the United States and elsewhere. Any leakage of that output to China cuts against both Taiwanese law and American export controls.
Why now?
Pressure has built from two directions. The United States has tightened its own rules on advanced chips and chipmaking tools destined for China, and it expects partners to close loopholes. At the same time, Taiwanese authorities have documented repeated attempts to move restricted hardware through the island's ports and airports.
Smuggling cases involving advanced semiconductors have drawn attention on both sides of the Pacific. Enforcement actions in recent years have exposed networks that buy chips through front companies in third countries, then reroute them to Chinese buyers. Taiwan's geographic position between chip production and mainland demand makes it a natural transit point.
The proposed law signals that Taipei treats the issue as a criminal matter, not a paperwork violation. It also aligns Taiwanese practice more closely with U.S. export control enforcement, where criminal penalties are already standard.
Who is affected?
The measure reaches several groups:
- Taiwanese exporters and trading companies handling AI chips
- Freight forwarders and logistics operators moving restricted hardware
- Brokers and intermediaries who structure transactions through third countries
- Any party that knowingly participates in an unauthorized transfer
Legitimate license holders face no change. Firms that obtain authorization for permitted shipments continue under existing procedures. The criminal exposure attaches to unauthorized exports.
What comes next?
The legislation must pass Taiwan's legislature before it takes effect. Details on penalties, sentencing ranges and enforcement mechanisms will emerge as the bill moves through review. Companies moving chips through Taiwan will need to tighten compliance screening, because criminal liability changes the risk profile of any gray-market transaction.
If passed, the law would close one of the remaining gaps in the export control regime around advanced AI silicon, and it would raise the cost of smuggling at the point where most of that silicon is made.
